The Graduate Studies Office will accept unofficial transcripts and self-reported test scores for admission reviews. Any admission made with these documents would be conditioned on receipt of official documents, which should be provided as soon as possible.

Our program is unique in that all core faculty members are lawyers with doctorates in education, so you'll learn from people with practical expertise in the courtroom as well as the classroom.
The certificate is valuable for a wide variety of school professionals including: public and private school teachers; school leaders including special education directors, principals, department heads, and superintendents; coaches, social workers, school nurses, school counselors, higher education faculty; and higher education staff and administrators, particularly those in student affairs, admissions, and executive offices.
Non-school professionals can also benefit, including: graduate students who seek a concentration in education law, as well as attorneys and policymakers who seek expertise in this area. Individual legal research, conducted during the Legal Research Course, can also be higher education focused.

Education Law and Policy
This course focuses on the intersection of public schools, K–12 educational policy, and the law, exploring the crucial role education plays in sustaining a democratic society. Topics include the philosophy of public education, socialization and values inculcation in schools, control over curriculum content, student expression, religion in schools, equal educational opportunity, fiscal equity litigation, and school choice plans.
This upper level course covers the legal and policy implications of education in the United States. Students are required to write a research paper and to present their research project to the class.

K-12 Education Law
This course will examine federal, state and local laws governing K-12 public school districts. We will also explore applicable case law as we consider topics such as governance, curriculum, the right to an education, public funding, equal protection, disparities in the quality of education, freedom of speech, privacy rights, religion, school safety and discipline, charter schools, special education, teacher tenure, school district liability/immunity, and reform. Overall, the goal of this course will be to introduce and critically analyze the legal and socio-economic aspects of the K-12 education system in an effort to equip students with a better understanding and ability to anticipate, recognize and ultimately assist with the resolution of legal issues that arise within this dynamic and ever-changing environment.

Education Law: Constitutional, Statutory, and Policy Considerations. This seminar introduces students to the legal standards that govern public schools in the United States. Constitutional topics include the right to a public education, the financing of public schools, desegregation and equal opportunity of students, limitations on student speech, school discipline and the right to due process, religion in schools, and privacy rights of students. Statutory topics include federal laws such as the Every Student Succeeds Act, the Individuals with Disabilities Education Act, Title IX, and the Equal Educational Opportunities Act. Policy topics include school reforms, such as charters and vouchers, and the ongoing inequities in US public schools, and the school-to-prison pipeline, and recent restrictions on classroom curricula. A research paper is required; successful completion of the paper will satisfy the Substantial Research and Writing Project Requirement. A course pack will be used in lieu of a textbook, supplemented with materials posted on Canvas.

The fellowship program brings together a tightly knit cohort of a dozen second and third-year law ... students to spend one or two academic years working on the Rhode Center for the Legal Profession’s core research and policy-making projects. Professors David Freeman Engstrom and Nora Freeman Engstrom have co-directed the Rhode Center since 2021 and created the Civil Justice Fellows program in 2022. “It’s the Center’s jewel in the crown,” David says. “We are creating and nurturing a pipeline of talented young lawyers who care about these important issues.” An overarching goal of the Fellows’ program, says Nora Freeman Engstrom, Ernest W. Nature-based solutions can play a significant role in combating climate change by removing excess carbon dioxide from the atmosphere; yet, investments in reforestation and other nature-based projects are lagging due, in large part, to inadequate quantification and confirmation of carbon removals ... and other ecosystem benefits that typically flow from nature-based investments—including increased resilience to climate impacts, according to a new report from Stanford Law School’s Law and Policy Lab, the Stanford Doerr School of Sustainability, and the Bezos Earth Fund. SLS Professor and report faculty lead David J. Hayes commented, “Policymakers and investors are looking for proof that nature-based solutions can deliver measurable and verifiable carbon emissions reductions and removals—and they are not getting it...". Natural Resources & Environmental Law
The history and economic viability of Idaho and the Pacific and Inland Northwest is inextricably tied to its natural resources. Beginning with its Native American inhabitants, the people of the region have deep ties to its natural beauty as well as the opportunity for livelihoods provided by its abundant resources. Legal and political issues involving natural resources have figured prominently in the region’s history. The Natural Resources and Environmental Law program takes a transformative approach to legal education by focusing its curriculum and its interdisciplinary offerings at the intersection of law, science, and society. Our philosophy is that students should follow the leadership and counselor model of the legal profession by obtaining the breadth in education to guide clients to lasting solutions of the problems underlying resource conflict. The University of Idaho’s Moscow location allows collaboration with its nationally recognized natural resource, environmental and agriculture academic and research programs at Idaho’s Land Grant University with – making this an ideal place to study natural resource and environmental law (NREL).
Natural Resources and Environmental Law Emphasis
In 2008 Idaho Law introduced an emphasis in Natural Resources and Environmental Law (NREL), allowing you to earn a designation on your diploma upon completion of at least 16 hours of designated course work in the area and satisfaction of the Upper Division Writing Requirement under the advising of one of the NREL faculty. The program was developed in response to the general fact that the practice of law is becoming more specialized and specifically that the practice of natural resources and environmental law has become highly technical and complex. The course of study is designed to give you broad expertise in Natural Resources and Environmental Law and an understanding of how to develop in-depth expertise in a specific topic while not sacrificing your broader legal education. In addition, due to the strong collaboration between the College of Law and other Colleges at the University of Idaho through the development of concurrent degrees in Water Resources and Environmental Science, you will have the opportunity to enrich your experience by taking courses outside the law school and learning to integrate science and social science with law.

JD/MS or JD/PhD Water Resources Concurrent Degree
Launched in 2006, the University of Idaho Waters of the West (WoW) – the only interdisciplinary program of its kind in the Pacific Northwest and one of few such programs in the nation – draws on expertise of 56 faculty members in seven colleges to integrate aspects of law, natural resources, engineering, political science and more. The unique program focuses on developing sophisticated strategies and solutions to the world's critical water shortage. Students may obtain either an MS or a PhD in any of three tracks within the Water Resources Program concurrently with their JD. Double counting of 18 credits for the JD/MS and 21 credits for the JD/PhD allows completion of the JD/MS in four years and the JD/PhD in 6 years.
Students are required to apply separately to the College of Law and the College of Graduate Studies, Water Resources Program, and on acceptance to each college, must apply to the concurrent degree program. The LSAT may be substituted for the GRE on application to the College of Graduate Studies. Acceptance to both colleges does not have to occur simultaneously.

Course of Study
The first year will be completed entirely in the law curriculum. Students may begin taking graduate courses in their second year and should finalize selection of a graduate committee and filing of a study plan with the College of Graduate Studies by the end of their 2nd year. Law fees will be charged for the first 3 years of study and graduate fees will be charged for each subsequent year.
JD/MS Environmental Science Concurrent Degree
Rising interest in the connection between sustainable economic development and environmental protection has increased the demand for professionals with both legal and technical training. To meet this demand, the University of Idaho College of Law and the University of Idaho College of Graduate Studies Environmental Science Program offer a concurrent degree program.
The concurrent program combines the study of scientific, social, philosophical and legal aspects of environmental issues.
The program is designed to allow students to obtain both a J.D. from the College of Law as well as a M.S. Environmental Science from the College of Graduate Studies in as few as eight semesters through double counting of 18 credits.
To be eligible for the concurrent Juris Doctor (J.D.)/Master of Science (M.S.) in Environmental Science program, you must apply separately and be admitted into each program and then be admitted into the concurrent degree program. The LSAT may be substituted for the GRE on application to the College of Graduate Studies. Admission into the concurrent degree program is dependent on a demonstrated ability to excel in an intense, interdisciplinary educational environment.

Faculty Research Interests
You will select a faculty advisor in your first year of law school for the purposes of developing your course of study and your writing topic. You should select an advisor with research interests in an area you are interested in.
Jerrold Long
Dr. Long’s research is in land use law and subjects relating to the interdisciplinary “Water of the West” program at the University of Idaho. Professor Long is also an Affiliate Professor in the University’s Water Resources. His dissertation – New West or Same West?: Evolving land-use institutions in the American West – explored how local land-use regimes respond to social and cultural change.
Dylan Hedden - Nicely
Professor Hedden-Nicely interests include Native American natural resources law, water law, tribal treaty rights, tribal civil and regulatory jurisdiction, law and science, tribal economic development, tribal governance, Native people in the legal profession.
Richard Seamon
Professor Seamon has written two books on administrative law and many law review articles on issues of constitutional law and other public law subjects. He also served in the U.S. Department of Justice as an assistant to the Solicitor General of the United States.

This short essay explains why I teach the introductory constitutional law course historically. It explains the advantages of a historical approach and the problems of canon formation inherent in an introductory course, which for many students, is the only constitutional law course they will ever take. A historical approach is also a great way to bring constitutional theory into the introductory course, including debates about originalism and the uses of history in constitutional interpretation. The historical approach helps students learn to think about constitutional law from both internal and external perspectives; each perspective is essential to learning constitutional law, and each enriches the other. A historical approach also helps students understand the nature of constitutional revolutions, including the current changes wrought by the Roberts Court. Finally, a historical approach can help students understand the current moment of democratic backsliding in the United States and the country's periodic episodes of constitutional rot and constitutional renewal.

The Entrepreneurial and Transactional Clinic is a pillar of Drake’s business law program and has launched the careers of many alumni who now serve as innovators, leaders, and trusted advisors in practice. The Entrepreneurial and Transactional Clinic currently provides legal assistance to business startups, entrepreneurs, and community nonprofit organizations to help them establish successful for profit and nonprofit enterprises. The clinic targets entrepreneurs and innovators located in underserved Des Moines neighborhoods and rural Iowa communities who are not able to afford retained legal counsel. Candidates are welcome to reimagine the scope of the clinic to align with their teaching goals.
Job Summary:
Drake University Law School invites applicants from entry level and lateral candidates for a tenure-track, tenured, or long-term contract faculty position to direct the Entrepreneurial and Transactional Clinic beginning in the 2025-2026 academic year. The Director’s duties include supervising and advising students in the direct representation of clients. Other responsibilities include the following: docket selection and clinic design; supervision and assessment; teaching a weekly skills development seminar for clinic students; engaging in community education; and managing external grants. The position begins July 1, 2025, and will be a twelve-month appointment. Clinical faculty appointed on the tenure-track have a reduced scholarship requirement and the same rights and responsibilities of other full-time faculty, but with an emphasis on clinical teaching, professional competence and activity, research and creative work, and University and public service. The search committee is particularly interested in candidates who, through their research, teaching, and/or service, will contribute to the diversity and excellence of the academic community.
Minimum Qualifications:
Candidates must possess a J.D. or comparable law degree and be admitted, or able to satisfy the requirements for admission, to the Iowa Bar. An exceptional academic record, distinguished record of clinical teaching or extensive practice-related experience, a demonstrated capacity for excellence in teaching, supervision and assessment, and service is preferred. At least three years of practice experience is required.

On July 26, 2024, the U.S. District Court for the Northern District of Florida permanently blocked Florida’s Stop WOKE Act, which restricted the types of anti-harassment and antidiscrimination training that employers can require their workers to attend.
- The U.S. District Court for the Northern District of Florida recently upheld an injunction against part of Florida’s Individual Freedom Act, also known as the Stop WOKE Act, which regulated the types of content that employers could include in employee training.
- The court found that a section of the law was unconstitutional because it violated employers’ First Amendment rights to free speech.
- Florida cannot enforce the part of the law that prohibits employers from requiring employees to participate in training that supports certain beliefs about DEI.
On April 22, 2022, Governor Ron DeSantis signed the Individual Freedom Act (IFA), commonly referred to as the “Stop the Wrongs to Our Kids and Employees (WOKE) Act.” The law raised concerns for employers, as it restricted the types of antiharassment and antidiscrimination training programs that employers could require, particularly if the training addressed diversity, equity, and inclusion (DEI) topics, such as systemic racism, white privilege/white supremacy, or unconscious bias. As passed, the law prohibited employers from requiring workers to participate in a workplace training program if it “espouses, promotes, advances, inculcates, or compels” certain DEI-related beliefs.
Two employers sued to enjoin the IFA, alleging that it is unconstitutional under the First Amendment of the U.S. Constitution because it violates their rights to free speech. They claimed the law is vague and overbroad. In response, Florida argued that the law only regulates conduct, not speech, because it bans certain mandatory employee training programs.
On March 4, 2024, a unanimous three-judge panel for the U.S. Circuit Court of Appeals for the Eleventh Circuit ruled that the state could not characterize or reframe the law as a conduct regulation since it prohibited employers from holding training programs on particular subjects that the state disfavors. It upheld a temporary injunction. On July 26, 2024, the federal district court made the injunction permanent.
During the limited period of time the law was not subject to an active injunction, employers raised concerns that certain DEI programs and training could have the unintentional consequence of violating the IFA. Some employers may have felt the need to change or soften their training programs or remove discussions of systemic racism and unconscious bias. Other employers reluctantly made these trainings optional for all Florida employees, or for those who objected to completing them.
The latest court ruling puts collective minds at ease and maintains an open door for Florida employers to implement and maintain broad discrimination and harassment prevention training programs. Companies are allowed to discipline or fire workers who refuse to attend such training programs.
Florida employers might want to remain mindful to avoid potential discrimination and harassment claims from employees who object to such training programs under other applicable laws. In handling and proactively preparing for such objections, employers may want to review the content of these trainings to ensure they comport with federal and state antidiscrimination laws and do not inappropriately single out certain protected groups or mandate employees to change their religious beliefs.
Overall, the latest court ruling raises questions about whether state restrictions on employers’ discussions of and trainings on certain DEI concepts are lawful under the First Amendment and/or conflict with federal laws such as Title VII of the Civil Rights Act of 1964, which requires employers to take steps to prevent discrimination and harassment. Such state laws are likely to face legal challenges.
It is also worth noting that the Stop WOKE Act is politically charged. During the 2024 Florida legislative session, two companion bills were introduced that would have similarly sought to prohibit mandatory training on sexual orientation, gender identity, or gender expression. They did not pass. However, unless the political winds shift, employers with employees in Florida might want to watch whether similar bills are filed in 2025.

New gang resistance education and training program instructors to join philadelphia area schools.
PHILADELPHIA –Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Philadelphia Field Division hosted the graduation of 20 new Gang Resistance Education and Training (G.R.E.A.T.) program instructors today.
G.R.E.A.T. is an evidence-based, national and international gang and violence prevention program that has been building trust between law enforcement and communities for more than 30 years. The program partners law enforcement agencies with schools and youth organizations to provide law enforcement officer-instructed classroom curricula.
ATF Philadelphia Field Division Special Agent in Charge Eric DeGree welcomed the participants and commended them for their dedication to support this program. “Taking on an extra assignment, on top of your regular law enforcement duties, is tough. I appreciate each of you for stepping up and taking on this important task.” He further emphasized the importance of supporting the children in our communities. “This training will help you reach children in need. The more we can reach, the better we are as a city, a state, a nation and society.”
Local graduates of the four-day training program included Police Officers from Philadelphia, Abington and Morton Borough, a Special Agent from ATF Philadelphia Field Division, and a member of the U.S. Attorney’s Office for the Eastern District of Pennsylvania.
Demonstrating the G.R.E.A.T. program’s valuable legacy, two of the new instructors were G.R.E.A.T. program graduates in their youth; Brandon Smith of the Philadelphia Police Department, and Ebony Worthham of the U.S. Attorney’s Office for the Eastern District of Pennsylvania.
In the Philadelphia area, the 15 local graduates will support the Philadelphia school district, Abington and Morton Borough schools, and the Boys & Girls Clubs of Philadelphia.
“The most effective way to fight gang violence is to keep young people from joining gangs in the first place,” said Jacqueline Romero, United States Attorney for the Eastern District of Pennsylvania. “My office is proud to take part in the ATF’s G.R.E.A.T Program, alongside our law enforcement partners, working to bolster kids’ defenses against the ills of gang membership and violence. Our youth deserve support as they navigate their neighborhoods and lives, and outreach efforts like this can make an outsized difference.”
The program also graduated new G.R.E.A.T. instructors from U.S. Attorney’s Office for the District of Delaware; City of Clarksville, Tennessee; Nassau County Police Department, New York; and Bureau of Indian Affairs, Ft. Washakie, Wyoming.
“Since 1992 ATF has partnered with our state and local partners on G.R.E.A.T. programs throughout the country with the purpose combating violent crime through crime prevention,” said Veronica Morales Miller, ATF G.R.E.A.T. Acting Program Manager, who organized the training. “The ATF G.R.E.A.T. program gives our employees the opportunity to prevent violent crime by teaching children life skills that will help them become law abiding citizens. Students are taught how to set goals, resist peer pressure, respect differences, resolve conflicts and understand how gangs and drug abuse can negatively impact their quality of life and their community.”
