Applying for a spouse visa is quite, if not very daunting for most of us for the mere reason that it’s full of technicalities. The amount of evidence to prove the application is tricky and sometimes just overwhelming but hey ho! We do what needs to be done.

There’s no exact checklist for a spouse visa application. It all depends on your circumstances to include the category of financial requirement as well as the type of accommodation you’re using and not to mention the relationship status you have. Of all these supporting documents you’re preparing for submission, a covering letter sometimes gets lost amidst the chaos. And almost always, it’s a disaster! Hah!

So, what is a covering letter? Why is it important for the spouse visa application? The answer is simple but packs a punch. The covering letter shows a snippet of the whole nine yards of your application. It explains in summary the what, why, where, when and how of your application. This is usually filed on top of the application supporting documents with the intent to give the Entry Clearance Officer or the Case Officer the overview of your case/application.

A detailed covering letter should contain the following information:

  • Personal details for both the applicant and sponsor, e.g. nationalities, type of visa application, where you’re applying at and other personal information you think might be of help to your application;

A cover letter for UK visa is instrumental in persuading the ECO that you meet the visa requirements and have no intention of overstaying your visa. It gives you the opportunity to convince the ECO that you are a genuine visitor and you will promptly return back to your country.

A cover letter is a document to convey additional information that wasn’t asked in the UK visa application. It’s not a mandatory document but by far the most helpful document in increasing your chances of UK visa approval.

Why do you need a cover letter for uk visa.

The information asked in the UK visa application isn’t enough to convince the ECO that you will return back to your home country after your trip. 

Most questions on the UK visa application are close-ended. They don’t give you an opportunity to explain. 

A cover letter allows you to explain in your own words and be as descriptive as you can. You can use your own format and even use illustrations if needed.

Is a cover letter mandatory for UK visa?

No. A cover letter is not mandatory for UK visa. It’s not even a document in the documents checklist for UK visa.

When I applied for my UK visa, I did not submit a cover letter. At that time, I didn’t know the importance of a cover letter for UK visa. I didn’t feel the need to explain anything additional, so I didn’t submit one. My visa was still approved. 

That’s not the case for everyone. A cover letter will not hurt your chances of approval, it can only help. It gives you an additional opportunity to convince the ECO. 

If I apply again for my UK visa, I would definitely submit a cover letter. 

What should you write in the cover letter?

A cover letter is not a mandatory document for UK visa. So obviously, UK Visas and Immigration (UKVI) does not provide any guidelines on what to include in the cover letter.

Write your cover letter in simple words as if it’s meant for a 5th grader. If the language is too complicated to read, ECO will not bother to read it. 

Do not use words that people from your country can only understand. ECOs are from the UK and they can only understand the terms that they use in the UK. 

Example: It’s common for people in India to say something like “ please do the needful and revert back to me “. Even though it’s still understandable, saying something like “ please let me know if you need anything else from me ” will help the ECO understand better. 

Remember, a cover letter is not a mandatory document. ECO is doing you a favor by reading it. So, make it easy for the ECO.

Your cover letter should never be longer than two pages. ECOs rarely have time for things other than what’s asked in the application. If you present them with a booklet, they will toss it in the trash without even looking at it. 

Again remember, a cover letter is not mandatory. It should not consume too much of ECO’s time.

To further simplify your cover letter, format it with subheadings, bullets and highlights. This helps the ECO to quickly glance over the letter and read any section that interests them. 

Example:   Instead of writing like this – 

“ I intend to travel to the UK for tourism from 20 June 2021 to 24 June 2021 and I plan to visit various attractions in London such as Buckingham Palace, Tower of London, Tower Bridge, London Eye, Madame Tussauds, National Gallery, etc. “

Write like this – 

  • I intend to travel to the UK for tourism. My travel dates are from 20 June 2021 to 27 June 2021. 
  • 20 June 2021: Arrive at Heathrow International Airport at 3 PM. Check-In and dinner.
  • 21 June 2021: Visit Buckingham Palace and the Tower of London
  • 22 June 2021: Visit Tower Bridge and London Eye
  • 23 June 2021: Visit Madame Tussauds and National Gallery
  • 24 June 2021: Depart from Heathrow International Airport at 10 AM

Sections in the cover letter

Templates for UK visa by Visa Traveler

It’s important to break the cover letter into different sections. This helps the ECO quickly glance through the letter and understand the gist of it. If needed, the ECO can read specific sections. Your cover letter for UK visa must contain the following sections.

Section 1: Your previous UK visa refusals

In the UK visa application, there is a question on previous UK visa refusals. It asks about your previous UK visa refusal and its details. This question asks you to explain why your UK visa was refused but doesn’t ask why it shouldn’t have been refused

There is no other place in the application to address your previous visa refusals either. There is the “additional/extra information” area, but it’s only for text and not suitable for formatting or pictures. Therefore, the cover letter is the most appropriate place for addressing your previous UK visa refusal. 

If you are re-applying to challenge your UK visa refusal , include a section in your cover letter specifically for your previous visa refusal. Address your previous visa refusal with evidence, additional information and documentation. 

Keep this section as the first section in your cover letter. Having this section at the beginning of the cover letter will help the new ECO get straight to the point. Otherwise, they may overlook and your efforts of re-application may go to waste.

Here is an example.

Previous UK Visa Refusal

My previous application for the UK visitor visa with GWF number GWF12345678 was refused on 16 March 2021. 

I would like to address the reason for the refusal with additional information and documentation.

Reason for refusal: The sources of the deposit (£850) were not demonstrated by the documents provided.

Explanation: The deposit in question was made on 05-Dec-2020 for the amount of £850. This amount was the yearly bonus from my employer. Yearly bonuses are deposited in the first week of December every year. Please find the attached documentation to prove that these funds are available to me.

Additional Documentation: (1) Bonus slip, (2) bonus announcement email and (3) letter from my employer with details of bonus, amount and dates.

Section 2: Your travel purpose and itinerary

In this section, mention your purpose of visit and proposed itinerary in the UK. The itinerary must be detailed enough but not too descriptive to confuse the ECO. Format it with bullets and/or a table.

Proposed Travel Itinerary

  • I intend to travel to the UK for tourism for a total of 7 days. My travel dates are from 14 Oct 2021 to 20 Oct 2021.
  • My planned day-by-day itinerary is as follows

Section 3: People traveling with you to the UK

In this section, mention the people that will travel with you to the UK. If you are applying for the visa with your family members, mention their details such as name, passport number and GWF number. 

Each individual must submit one UK visa application. Say if a husband, wife and child are traveling to the UK together, each of them must submit a separate UK visa application. There is no easy way to tie these applications together. 

There is a question in the application asking for travel companions, but mentioning them again in your cover letter will help tie them all together. 

Travel Companions

I will be traveling to the UK with my wife and son. The GWF numbers of my wife’s and son’s UK visa applications are as follows.

Section 4: Your current employment/business or university details

In this section, mention your current employment details. Include details such as the employer’s name, how long you have been working and your current salary.

Employment Details

  • I currently work for Samcore Logistics, LTD, Dubai as a product manager.
  • I have been working as a product manager at Samcore Logistics, LTD since Nov 2014.
  • My monthly salary is 7,000 AED after taxes.
  • An original letter from my employer, a leave approval letter and bank statements indicating the salary deposits are attached.

If you are a business owner, mention the details of your business such as your business name, your role in the company, yearly revenue, etc.

Business Details

  • I own a construction business in Dubai since 2016. I’m the founder and president of the business.
  • The business has been in positive cash flow since its inception with yearly revenue of 300,000 AED.
  • A copy of my business registration, business license, bank statements and tax returns are attached.

If you are currently a student at the university, mention your university details along with the program, major and semester details.

University Details

  • I’m a full-time student enrolled in the undergraduate program at the University of the Philippines.
  • I’m currently in the second semester of my second year with another four semesters remaining to graduate.
  • A letter from my university and the fee payment receipts are attached.

Section 5: Your current financial situation

In this section, mention your source of income, savings and the bank statements for your UK visa . 

If you have multiple bank accounts, this section is a good place to talk about it. Explain why you have multiple bank accounts and how they are connected.

Financial Solvency

  • I currently have 300,000 INR (approx. 2,900 GBP) in my bank account.
  • The source of my savings is my salary from my employer, WinTech Corporation.
  • The last 6 months bank statements and payslips are attached.

It’s quite common for many to work in a foreign country and send all their earnings back home for family maintenance or savings. In such cases, you will have to submit bank statements from both countries, but most importantly, mention that clearly in this section.

If you use a broker or third party to send cash back home, errors can occur and transactions may not match. I highly recommend using a money transfer service such as Wise to transfer cash back to your home country.

Section 6: Your sponsorship information

If you are paying for your trip yourself, this section does not apply to you. Have this section in your cover letter only if someone else is paying for your trip. 

In this section, mention your sponsor details, your relationship with the sponsor, what expenses they will bear, etc. 

Sponsorship Details

  • My brother is sponsoring my trip to the UK.
  • He will bear all my travel expenses while I’m in the UK including accommodation, food and transportation.
  • A letter from my brother, his UK residence permit, employment proofs, bank statements, his apartment lease contract and the document to prove our relationship are attached.

Section 7: Your travel history

In this section, mention your travel history. Travel history is very important and highlighting it will only help with your UK visa. Your travel history can include all your previous travels to the UK and other countries. If you have traveled to a country multiple times, mention that country only once.

Travel History

  • In the last 5 years, I have traveled to 8 countries for both tourism and business. 
  • The countries I have traveled to are Hong Kong, South Korea, Japan, Indonesia, Malaysia, UAE, Turkey and Denmark.
  • A copy of my visas and entry and exit stamps from all the above countries are attached.

Section 8: Any family members staying back at home

In this section, mention any family members remaining at home during your UK trip. This helps prove your family ties with your country. Family ties indicate that you will return back to your country after your trip. 

Do not include this section if it does not apply to you.

Family Remaining at Home

  • I currently live with my wife and two children.
  • My wife and children will remain at home during my trip to the UK.
  • A copy of my wife’s employment proof and children’s school receipts are attached.

Section 9: Your intention to return back

In this section, mention that you will promptly return back after your trip and the reasons for that. Reasons can be employment, business or attending to family needs. 

Intention to Return Back

  • I intend to return to Pakistan after the end of my UK trip on 27 Oct 2021 as I have to report back to my employer and continue at my job on 28 Oct 2021.
  • An original leave approval letter from my employer is attached.

Section 10: Any miscellaneous information

If you want to add something that didn’t fall under any specific section above, you can include it here. This could be something about properties you own (economic tie), your rental situation, covid safety precautions, etc.

Miscellaneous

  • I currently live in a rental apartment. A copy of my rental contract is attached.
  • I own farmland with my wife. A copy of my property ownership document is attached. 
  • I assure you that I will follow COVID safety precautions throughout my trip.

A cover letter is not a mandatory document for UK visa. But in my experience, it’s the most helpful document. The goal of the cover letter is to convince the ECO that you are a genuine visitor. Your cover letter must be simple, short and clear. Break the cover letter into sections, paragraphs and bullet lists. Use pictures and screenshots if necessary.

Hi Thirumal, I love your articles and it has been really helpful, I applied for my Mums EUSS dependent Visa to travel to the UK which got rejected due to insufficient money transfers. It takes nearly 6 months to get a reply from them sometimes more than that. I need my mum to travel to the UK to be present for my delivery in July so I wanted to apply for a visiting visa. Hi Kiesha! Yes, it can pose an issue. I have seen cases where a visitor visa was refused due to a previous EUSS refusal. ECO assumes that the applicant is taking a different route to gain entry into the UK. So you will have to put more effort into convincing the ECO, through additional documentation and a cover letter.

Hi Ankit! 1. To avoid complications, you should mention the new address (flat from December) as the “accommodation” address for your mother-in-law. 2. Yes. This is becoming very important and UKVI is very strict about this. Your mother-in-law must have her own income and savings. If she doesn’t, then the person on which she depends, ex: father-in-law. Also, make sure to show any properties that she owns and family members that will remain in her country during her UK trip.

Hi Darshita! TLS forwards the application to the local UK embassy or consulate in Germany. So you can address the cover letter to “The Entry Clearance Officer, Embassy of the UK in Germany”. Who you address your cover letter is not that important. The content of the letter is important though.

Hi Raymond! Yes, even if your wife is sponsoring your application, you must provide your own bank statements too. Your income/savings do not have to meet the financial requirements since you are seeking sponsorship. If you have a decent income and can provide bank statements, you should be fine.

The Entry Clearance Officer The Consulate General of the United Kingdom, Pune, India

There may not be a consulate of the UK in Pune. Your application might be sent to the consulate of the UK in Mumbai or New Delhi. But just using the city where you are applying is fine. Many readers have done that and none of them faced any issues. What’s important in the cover letter is the content, so you will be fine.

Hi Dharshine! Yes, your husband can sponsor your application even though he will not be traveling with you. He would need to write a sponsorship letter and provide all his documents. Similarly, you would need to mention all these details in your cover letter.

Hi Pujan! Yes. You must mention your Netherlands visa refusal and the reasons for its refusal in your UK visa application. You don’t have to mention your UK visa application withdrawal. It’s are not a refusal, so no need to mention.

Hi Shalini! If you are re-applying immediately after a refusal, it helps to mention it in your cover letter so you can address it. But there is no need to mention a refusal that happened 12 years ago in your cover letter. However, you will have to mention all visa refusals, even if they happened 12 years ago, in your visa application form.

Hi Adeleke! If your self-employment is registered as a business, then you must submit both business and personal bank statements. Your salary deposits must match those bank statements. If you only submit your business bank statements, then you must write a letter on your company letterhead that your business funds are available for personal use.

Hi Foster! I recommend keeping your cover letter to one page or two pages max. A cover letter is not a mandatory document so keeping it to one page has a higher chance of ECO reading it. If it’s too many pages, the ECO may skip reading it.

Hi Bankole! From your side, you must show that you have sufficent income and savings to support your trip incase your employer decides not to support you after you land in the UK. Your income and savings doesn’t have to conform to £150 a day requirment since your employer is sponsoring you. So if you have savings enough for a flight back home should work fine too.

But he lives in the village and he is a farmer (a cash business and he deposits the money in his bank). He has money in his bank statement equivalent to £1000. how can we prove this source of income please. He is a village man farming and selling in the village and Saturday markets. What documents should he submit?

The land he is farming on is our inheritance and the land title is in his name but as an administrator, pending the transfer to his name. Is this sufficient. The letter of administration from the court mentions him as the son of the late.

Yes. That should be sufficient to prove that the land belongs to him. It also needs to be properly explained in the “extra information” section within the UK visa application and also in the cover letter.

Hi Oladimeji! If you have considerable travel history, for example, 5 or more, then you don’t have to worry about not mentioning Cyprus. If you don’t have good travel history, then cancel your application and fill out a new one. You can get a full refund of the visa fee if you haven’t given your biometrics yet. And the cover letter is necessary either way.

Hi Alec! An admission letter will not be sufficient. You need proof that you still have a certain number of semesters left and you have pre-paid your tuition for the future semesters. At least 1 or 2 semesters would be fine. A home lease contract also helps.

What is the visa approval success rate for a spouse that is not working at the moment and going with her husband and kids to the UK for holiday? 3. Can the husband sponsor wife’s UK visa application/trip even though she’s employed?

Hi Sam! I appreciate the kind words! 1. Even though you all apply together, each application is assessed individually. You will have no control over whose application will be assessed first and in which order. The only thing you can do is to mention everyone else as their travel companions in each of your applications, and also in the cover letter. 2. The approvals are high as long as the husband can sponsor her application, prove the relationship and prove that she and her husband have strong ties with their country. 3. Yes, the husband can sponsor his wife’s UK visa application. There is no need for the wife to be working or employed.

Hi Mills! Documents proving any kind of ties with your country are essential to make a strong case. Your marriage certificate will prove your family ties and house paperwork will prove your economic ties with your country. So yes, make sure to provide those two. Mentioning your car is not necessary.

Hi Navid! Unfortunately, my knowledge and experience are only in tourist visas. So I’m not sure if a cover letter is necessary for an ILR application.

The next again I tried and was refused because the first information says I don’t have dependents and that’s because they don’t live with me. Hi Esther! You already know your refusal reasons. Make sure to fix them in your re-application. Provide proof that you have dependents (family ties) and provide a detailed cover letter. Follow the instructions from this article for the cover letter.

Hi Thirumal, I’m doing the application for a UK visa for my parents, both retired, and they live in Albania. Their pension is not a great amount of money and my siblings and I, we all contribute monthly to their financial situation of their living there. I’m covering all their expenses from the start to finish of their visit to the UK. I’ve prepared a cover letter from my part explaining their intention of coming in UK for Christmas and that I’ll be covering everything.

Their visas have been refused 2 times before. Now my concern is “On their cover letter should I explain their pension as an income and that their children give financial support on their living, or should we live this out of the cover letter.

I understand that their pension money only is not enough, and there is a section on the application asking about their salary and other forms of income and how much they spend monthly. this is a bit tricky for pensioners as they will have to spend all their money for their living in my country, and also the extra they get for us. Do we have to explain this in the cover letter? Will this still be an issue for the application?

Just to mention again I’ll be covering their expenses while travelling. They have savings as their own 4000Euro, which they have accumulated while they had worked previously, My mom had a small tailoring shop. Will this be enough for them? Thanks!

Hi Bruna! The UK visa application is mainly meant for employed individuals. The questions are not quite relevant to retired, students, housewives, children, etc. That’s where the question “extra information” and the cover letter come in handy.

In their cover letters, yes, mention that they rely on both their pension and support from their children. This is quite normal in most countries, so I don’t think it would be difficult for the ECO to understand.

For employment questions, they can mention that they are retired. If that option is not available, they can select unemployed. For the question on other income or savings, they can mention their monthly pension and support from children. It’s ok for the living expenses to be equal to their pension and support. This won’t hurt their visa approval as you will be sponsoring their trip.

For any trip expenses related questions, make sure they put zero for them since they will not personally spend anything on the trip.

Yes, it’s essential to mention all of these in their cover letters and a summary of them in “extra information”.

Yes, 4,000 euros of savings should be enough for them since they will not personally spend anything from their side on the trip. You will bear all their trip expenses.

Lastly, a couple of important things. – Most of the time, UKVI will not scrutinize retired applicants. So, no need to worry about their pension and savings. ECOs will mostly focus on your income and savings as you are sponsoring them. Make sure you have all the documents needed. Also, if you know the reasons why their previous visas were refused, let me know, so I can give your more accurate advice based on that. – Even after explaining everything in the cover letter, a lot of time ECOs make decisions based on the numbers like salary, savings, etc in the application. This is unfortunate, but when this happens, a lot of times, the applicants see success either with a PAP or reapplication.

Hi H Ali! If your country is on the red list, your UK visa application will not be accepted by the VFS. Even if they accept your documents, UKVI will put your application on hold till Srilanka comes out of the red list.

Hi Pradeep! A cover letter is not mandatory for a Canada visa. But I usually recommend one since it’s the easiest way to convey information that’s not asked in the application. You can provide a cover letter for both online and paper applications. If applying online, you can upload the cover letter for “Letter of explanation of your trip”. Letter of explanation of your trip will be one of the items in document upload.

1. I am planning to apply for a visit visa, I have my employment contract (25 pages) and also a leave letter from my HR. Do I need to submit both documents or just the leave NOC letter from my HR is fine?

2. Is it also necessary to submit my house rental agreements?

3. Also I have been refused a US visa some years ago which I declared in my application. But do I have to submit a copy of my refusal letter in my UK application and specify this in the cover letter also?

Hi Quincy! 1. Both the Employment letter and leave approval letter are necessary. Employment letter will have details such as how long you have been employed with them, your salary, job duties, etc. Therefore, you need an employment letter too, not an employment contract. You can have your HR write a one-page employment letter for you. If you need a template, email me. 2. Yes. It will demonstrate your economic ties with your country. 3. No. You do not need to submit your US visa refusal letter. You also do not need to mention your US visa refusal in your cover letter.

Hey dear, I have a couple of questions to ask related to the UK visit visa application. Considering my family is applying where my father is the head, my mother is a housewife and I am a student. All my queries are stated below.

1) There is a question in the application which says how much money you intend to spend on this trip personally, so what should I write for my father, me and my mom. I cannot put zero in mine and my mum’s because it doesn’t allow it.

2) My father was refused a UK visa back in 2012, The application asks for it but he doesn’t have the refusal letter so what should I write in the application.

3) Me and my mum applied and got the visa last December but we couldn’t go due to red list issues and increased corona cases. So should I mention that in my application on why we didn’t travel even though we had the visa then?

Hi Muhammad! 1) Even though you are not personally spending on your trip, you must still enter the amount per individual. You can divide the total expense by 3 and enter that amount for each of you. 2) You can simply enter “ECO discretion” or “Do not remember the refusal reasons”. This will not hurt your visa result in any way. 3) Mentioning that you had a visa and could not use it will only work towards your benefit. So make sure to mention it in the “additional/extra information” within your application and also in your cover letter.

I see. That’s a bit complicated. I suggest dividing the total expense by the amount of time spent in the UK by each. From your example, since your dad will spend 60days, you will spend 20days and your mom will spend 20days, divide the total budget by 60%, 20% and 20%. That should work.

If someone is sponsoring your trip, you will only enter the amount that you personally spend on your UK trip. For example, if they cover your accommodation, food and transportation and you will pay for shopping and souvenirs. Then you will enter the amount you will spend on shopping and souvenirs.

Therefore, most sections in this article will apply to your situation except the travel purpose. Hi Fathia! If your father is sponsoring and he also deposited cash into your account, he can explain that in his sponsor letter. You can also explain the same in your cover letter. Hi Ofori! There is a distinction between INVITATION and SPONSORSHIP. To know what documents you need for the UK visa, you would first need to understand that your brother is simply inviting you to visit him or sponsoring your trip. Below are the documents you will need.

Invitation – Your brother’s UK passport (or his home country passport) – Your brother’s UK residence permit (if he is not a UK citizen) – An invitation letter from your brother stating that he is inviting you to visit him in the UK

Hi Nana! Yes, if you co-own a property with someone, you can provide the ownership document as proof of economic tie with your country. Bank statements must be for the latest 6 months. No need for statements from the previous application. The most recent 6 months should work fine.

Bank statements in some countries require an official attestation from the bank. You will know if that’s how bank statements are used in your country for all purposes. If your company name is different from the deposit transaction in your bank statements, you can explain it in your cover letter.

Although it is not an official requirement to provide one, It is still frequently debated on internet forums and social media channels whether a Cover letter should be included in a UK Visa application. Cover letters are usually written by Immigration professionals as part of their client’s visa application. However, applicants and/or sponsors can also write their own cover letters if they are doing the application without a legal representative managing the application on their behalf. As mentioned above, if you choose to hire a legal representative to manage your case, it is usually included as part of their service. But if you are completing your/your partner’s application all by yourself, it is for you to decide as to whether providing a cover letter will be beneficial to your case or not.

What is the purpose of a Cover letter?

Cover letters are generally known as a document that is usually attached to a CV (curriculum vitae) or a job application. It provides a brief overview of your experience, skills, and qualifications, and to demonstrate your suitability for the position or opportunity you are applying for.

In the context of a UK Spouse visa, a cover letter plays a similar role. It is a letter written for the UK Home Office case worker, explaining the purpose of your visa application and to provide additional information about your relationship with your spouse (and dependants if applicable).

What information should I put in my Spouse/Partner Visa Cover Letter?

The primary purpose of the cover letter is to outline all the immigration rules pertaining to the visa and confirm that the applicant meets all of them. Effectively, it can act as a quick reference and/or provide further clarification for the Home Office case worker assessing the application. Therefore, to make your cover letter effective, try to focus on the essential points that are relevant to your case. There is no benefit in sharing the entire history about you, your partner and your relationship. - These facts may be important to you, but much of it won't be of importance to the case worker with regards to assessing if you satisfy the relationship test requirement. Briefly lay out how you meet each of the requirements for your application, including summaries of the relevant evidence you are submitting to prove it (you do not have list of every single document you will be providing). You can also mention and address other factors about your case which you feel may be significant, and you were not able to fully explain/include on the application form. Also, if you choose to include any important dates and figures that you have also entered on the application form, be sure that they all match to avoid any unnecessary suspicion from the case worker.  

Should the Applicant or Sponsor write the Cover Letter?

To answer this question, it is important to highlight what the difference is between a cover letter and a letter of support from the sponsor, when it comes to a UK spouse/partner application.

Cover Letters As already stated, a Cover letter provides a brief overview of your case and can also be used to raise and explain aspects of your specific circumstances, which you feel are important for the Home Office case worker to consider when reviewing your application.

Sponsor Letters of Support Sponsor letters are written by the British or settled spouse/partner and should confirm that the relationship is genuine and subsisting. It must also convey that they are willingly sponsoring their partner’s application. Invitation Letters These are usually only applicable for visitor visa applications when there is a UK sponsor/host and they need to explain the purpose of the applicant’s trip and relevant arrangements being made, such as who is covering the travel costs and providing accommodation for the applicant etc, during their stay.

Are there any other letters i need to include with my application.

Other letters that you must provide for your application will be subject to your specific circumstances. This particularly relates to your current financial situation and accommodation. For example, if you are relying on your sponsor’s employment income to meet the financial requirement, it is mandatory to provide a letter from their employer. Or another example is if you and your spouse/partner will be living at a property which is owned by family or friends, they would need to provide a letter to confirm that they consent to this.

Immigration officials, from the U.S. Department of State and also U.S. Citizenship and Immigration Services (USCIS), scrutinize spouse relationships more than other types of immigrant visa applications. That’s because there has been a historically high rate of visa fraud for marriages as compared to other relationships. Therefore, immigration officials want reassurance that the marriage is legitimate and that the foreign spouse is obtaining a green card based on a genuine relationship. This article reviews the requirements for a spouse visa, steps to apply, and how to make sure you're doing it correctly.

Why are there different (IR1/CR1) spouse visas? Who is eligible to sponsor a spouse? What are the specific steps to get started on a spouse visa? Is the process different if my spouse is in the U.S. or abroad? How much does this cost? What else should I know about? How long will it take for my spouse to get a green card? Spouse Visa (IR1/CR1 Visa) Explained

A “spouse visa” in this article is a term to refer to an immigrant visa (green card) for spouses. The U.S. government may issue an immigrant visa to the foreign national spouse of a U.S. citizen or lawful permanent resident. You may hear terms like IR1, CR1 and F2A to describe the visa types. The fact is, you have no choice in the matter. These "classes of admission" are based on the type of qualifying relationship, the duration of the marriage, and sometimes the type of admission. Here are some common examples:

  • IR1: Lawful permanent residence granted to the foreign national spouse of a U.S. citizen
  • F2A: Lawful permanent residence granted to the foreign national spouse of a permanent resident
  • CR1: Conditional permanent residence granted to the foreign national spouse of a U.S. citizen

Spouses admitted under the IR1 or F2A categories receive a permanent resident card, also known as a green card. Although permanent resident status is generally permanent, these cards are valid for a period of 10 years and must be renewed at that point. For couples who have been married less than two years at the time the immigrant visa is granted, the government will issue a “CR1” visa. CR1 spouses are issued a conditional green card that is valid for a period of two years. Within the 90-day period before the card expires, conditional residents must " remove the conditions on residence " in order to maintain status. Many spouse visa beneficiaries are approved as conditional residents.

Eligibility to File a Visa Petition for a Spouse

Before a foreign national may actually apply for a spouse visa, the U.S. citizen or permanent resident must file a petition to establish the existence of a qualifying relationship. Although there are additional requirements for a successful spouse petition, the eligibility is fairly straight forward. The petitioner must:

  • Be a U.S. citizen or permanent resident (age 18 or over); and
  • Be legally married to the foreign national spouse.

The visa petition starts the process. Initially, the U.S. citizen or permanent resident files Form I-130 (Petition for Alien Relative) and Form I-130A (Supplemental Information for a Spouse Beneficiary) with USCIS. The visa petition package establishes a qualifying relationship and requests the U.S. government to make a visa available to a foreign national spouse.

Same-sex marriages and marriages to transgender spouses are included in marriage-based green card petitions. In other words, they are treated the same as opposite-sex marriages.

Filing Your Spouse's Petition

Filing the petition package involves more than just the government forms. It’s extremely important to prepare a complete I-130 petition package with all of the necessary supporting documents when filing for a spouse visa. USCIS may send a Request for Evidence (RFE) if any information is missing. This additional step will delay the case and increase the time it takes to approve the petition. The typical I-130 petition package will include:

USCIS Filing Fee

Submit a payment for your USCIS fees. Make the check or money order payable to U.S. Department of Homeland Security. (The fee is $535 fee at the time of writing this article.)

Cover letter (optional)

A cover letter is not required, but it can help itemize the documents that you are submitting and highlight any extraordinary circumstances that you want to clarify. Review a sample I-130 cover letter .

Form I-130, Petition for Alien Relative

Submit an accurately prepared visa petition. A well-prepared petition is the best way to keep your case on schedule. Don’t forget to sign.

Form I-130A, Supplemental Information for Spouse Beneficiary

The Form I-130A is only required for the beneficiary spouse. If your spouse is outside the United States, he or she is not required to sign Form I-130A.

Proof of status

If you are a U.S. citizen, submit a photocopy of a birth certificate (if U.S. born), passport, naturalization certificate, certificate of citizenship, or consular report of birth abroad. If you are a lawful permanent resident, submit a photocopy of both sides of your green card or other proof of permanent residence.

Marriage certificate

Include a copy of your marriage certificate to prove that there is a family relationship between you and your spouse.

Proof of previous marriages terminated

If either you or your spouse were previously married, submit copies of documents showing that all prior marriages were legally terminated such as a divorce decree or death certificate (if the marriage was terminated due to the death of a spouse).

Passport photos

Submit two passport-style color photos of yourself and two passport-style color photos of your spouse taken within 30 days of filing the petition. (Exception: The foreign national spouse does not need to submit photos if currently residing outside the U.S.)

Evidence of a bona fide marriage

Include evidence that you have a bona fide marriage. It’s important to demonstrate you married for genuine reasons, not to evade U.S. immigration laws for the sole purpose of obtaining a green card. You’ll need to submit copies of documents that show evidence of shared financials liabilities, assets, insurance, tax filings, birth certificates of child born in to the marriage, or other documents that you feel shows your bona fide relationship. Your Spouse's Path to a Green Card

The information above assumes that your spouse is outside of the United States. Upon approval of the I-130 petition package, USCIS forwards the case to U.S. embassy or consulate where your spouse will ultimately apply for the visa and interview. This is called consular processing. However, in certain cases when a spouse is inside the United States, your spouse may be eligible for adjustment of status.

Consular Processing

Most family-based green card applications go through consular processing . The applicant is located abroad and interviews at a U.S. embassy or consulate.

The basic steps through the spouse visa process are as follows:

  • File I-130 Petition Package with USCIS
  • Obtain USCIS approval (or denial) on petition
  • Submit Affidavit of Support (I-864) and other documentation to National Visa Center
  • Pay and apply for immigrant visa (DS-260)
  • Complete required medical exam
  • Attend visa interview at the U.S. embassy or consulate
  • Receive immigrant visa in passport
  • Pay immigrant fee online
  • Travel to United States
  • Receive physical green card in the mail (typically about four weeks of entry)

Adjustment of Status

Certain spouses who are already inside the United States may be able to adjust status to permanent resident . This means that they would apply for the green card inside the United States without the need to travel abroad for an interview. This option is not available to everyone. Eligibility requires that the foreign national spouse:

  • Be physically present in the U.S. through a lawful entry; and
  • Have an immigrant visa immediately available to them.

Typically, physical presence should be through an entry with nonimmigrant intent. For example, your spouse shouldn't enter on a B-2 visitor visa with the preconceived intent of adjusting status .

When adjusting status, generally there is no need to file Form I-130 and wait. Instead, the foreign national spouse may file an adjustment of status package that includes Forms I-130, I-130A and I-485 (Application to Adjust Status).

Forms & Expenses for Spousal Immigration

The cost considerations below are for a spouse visa through consular processing. The adjustment of status path (for applicants physically present in the U.S.) come with additional costs.

There are other costs associated with an application for a spouse visa. For example, every applicant must attend a medical exam completed by an embassy-approved physician. There is no fee for the form. However, the doctor will charge a fee for the exam. The cost of the required medical exam will vary by country, doctor, and any additional vaccinations that may be required. Other costs may include photos to submit with the application, postage, and any transportation fees associated with travel to a consular interview.

Inadmissibility

After USCIS approves the immigrant visa petition and a visa is available, the foreign national applies for the actual spouse visa. Immigration officials will review the intending immigrant’s background for grounds of inadmissibility. In fact, everyone who applies to enter the United States is checked for inadmissibility. In general, immigration officials will not allow intending immigrants with histories of criminal or terrorist activities, drug abuse, infectious medical problems, or certain other characteristics to enter the U.S.

The following list summarizes some of the major classes of inadmissibility. In some cases, a waiver can be obtained.

People with communicable diseases like tuberculosis
People with physical or mental disorders that may cause harm to themselves or others
Drug abusers or addicts
Drug traffickers
People without proper vaccinations
People with convictions for crimes involving moral turpitude
Prostitutes
People with multiple criminal convictions
People who have violated immigration laws
Spies
Terrorists
Nazis
People likely to become dependent on need-based government assistance

Processing Times to Get a Spouse a Visa

As mentioned in a previous section, the I-130 petition is a request by the U.S. citizen or permanent resident to make a visa available to a foreign spouse. For spouses of U.S. citizens, a visa is always available. Spouses of U.S. citizens are considered immediate relatives . On the other hand, spouses of permanent residents are considered family preference immigrants and may experience a bit more of a wait for a visa to become available. However, once USCIS approves the petition, the process is essentially the same for both.

For many spouse visa cases, the process takes less than a year. The entire spouse visa time line can vary for your case. As mentioned, I-130 processing times vary by type of relationship (immediate relative or family preference). Other factors that affect processing time include the workload where your paperwork is processed and how well you prepare the petition.

Getting a visa before marriage.

There is alternative path for couples not yet married. The fiancé of U.S. citizens may generally obtain a K-1 visa to enter the United States for the purposes of marriage. The foreign national must marry the U.S. citizen within 90 days of entry to the U.S. If not married at this point, he or she must depart the country. Once married to the U.S. citizen, the K-1 visa holder may adjust status to permanent resident.

IR1 / CR1 Spouse Visa Step-by-Step Guide on Filing an I-130 for a US Spouse Visa

What is a IR-1 / CR-1 Spouse Visa? IR-1 / CR-1 Spouse Visas are immigrant visas issued to foreign spouses of US Citizens. After the US citizen spouse files (and has approved) the proper petition with the USCIS, the foreign spouse will complete the visa process completely outside the US. Upon approval and once issued, the foreign spouse may enter the US with their visa and pass through the arrival Port of Entry, where they will become a Permanent Resident immediately. They will receive a Permanent Resident Card (Green Card) in the mail at their US Address within a few weeks. Note to K3 Applicants:   This process also applies to K3 Visa applicants whom have had their I-130 approved prior to their I-129f. In this case you may chose to persue the I-130 path as opposed the the K3. This will allow the immigrating relative to enter as a permanent resident as opposed to having to file for adjustment once here. If the I-129f is later approved and forwarded to the embassy then you can write them to request the approved I-130 be acted on and the K-3 process abandoned. Who is Eligible to File? U.S. citizens legally married to a foreign national may petition for a IR-1 / CR-1 visa. If the marriage is less than two years old, the consulate will issue a CR-1 Visa (and if longer than two years it will issue a IR-1 Visa). The primary difference between these two visas is that a CR-1 Visa will result in Conditional Permanent Residency (requiring a   petition to be filed later to lift this conditional status ) versus a IR-1 Visa resulting in full Permanent Residency upon arrival in the US by the foreign spouse. Forms Needed to File for a IR-1 / CR-1 Spouse Visa: 1.   I-130 2.   I-130A 3.   G-1145   (optional) The above forms can be filled out on your computer and printed. Make sure you sign and date them as required. Anything you cannot fit by typing, you can handwrite (very neatly) in black ink in the blank instead. You should always verify the current forms at   www.uscis.gov . Assembling the I-130 Package: Checklist Forms and Documents (follow   these   assembly instructions. All supporting documents must be in English or be   translated   as noted   here .) :

Attach "E-Notification" Form (Optional) Clip a completed G-1145, E-Notification of Application/Petition Acceptance, to the first page of your application (on top of the cover page). By completing this form and attaching it, USCIS will send you an email and/or text message to alert you when your application was received.  

Mail the I-130 Package to the USCIS You should mail the completed form(s) to the proper   USCIS address here   (Note the location & PO Box address for your filing type:   stand alone ). Mail the package with return receipt requested / delivery confirmation. Send via USPS.

IMPORTANT! Make   TWO   copies of the entire package before you send it in. This includes the money orders too. You want to have a perfect replica of the package you are sending in. All Forms that you submit must be originals with original signatures. Supporting Evidence that you submit may be photocopies. Retain   ALL   original supporting Evidence since the USCIS has the right to check them by issuing an RFE ( Request For Evidence ). If you receive an RFE , follow the direction exactly, and make two copies of what you sent back. During any future interviews the USCIS may also want to examine the original supporting evidence.

What Happens After You Mail the I-130 Out? A few weeks after you have sent your petition to the USCIS you will receive a Notice of Action (aka NOA ) letter indicating that they have begun processing your I-130 application. You can check the status of your application as well as other processing time information   here .

When your I-130 petition is finally approved, the service center that processed your petition, will send you another Notice of Action letter indicating your approval, and the forwarding of your approved petition to the   National Visa Center   ( NVC ) in Portsmouth, New Hampshire, along with a phone number to contact the NVC with. Your case will now only be dealt with by the NVC . The service center that you filed with, will have no more knowledge on the status of your petition or case.

A few weeks after you have received your last Notice of Action indicating the approval and forwarding of your I-130 application to the NVC , the NVC will send your relative a packet of forms that you and your relative must fill out before your relative can be given an interview date with a consulate abroad. The packet will likely contain instructions to fill out the DS-261 and DS-260 online forms, by the intending immigrant. An   I-864   form is also included that must be filled out by the petitioner (living in the US). The I-864 is the Affidavit of Support form that requires copies of the petitioners past 3 U.S tax returns (or   tax transcripts   which are free from the IRS) as well as any bank or financial records available (see the I-864 for exact requirements based on your case). The petitioner must make at least 125% above the   U.S federal poverty   to indicate to the U.S government that the intending immigrant will not become a federal charge to the government when he/she arrives in the U.S.. If the petitioner cannot meet these requirements, then he/she must still file an I-864, and find a joint sponsor who can meet the requirements on his/her own. When a joint sponsor is needed ,proof of their U.S citizenship or permanent residency is required. (i.e. copy of birth certificate, immigration status etc). The joint sponsor must be residing in the U.S, and he/she must also submit his/her past 3 years U.S tax returns along with bank or any other financial records available. The joint sponsor must submit his/her own I-864 form to accompany the petitioner's I-864 form.

Forms that may be either sent back (or requested to be gathered and kept for the interview) to the NVC or the consulate abroad (depending upon which consulate you are going through) before an interview date with a consulate abroad can be scheduled are as follows:

After the NVC or Consulate Abroad receives the above forms and supporting documents (which may not all be required to mail back at that time), an interview date will be scheduled for the intending immigrant at a consulate abroad. The NVC or the consulate abroad will send your relative a letter indicating at what time and day the interview is scheduled for, and of required forms that must be brought to the interview. Make two copies of each original document or piece of evidence below and bring them with you. Documents needed are:

On The day of your relatives (or spouses) interview, he/she must bring EVERY document listed above that applies to your case, and should be prepared for a long wait. There may be additional forms required. The interview appointment sheet will contain a list of everything you must bring. It will also tell you the payment amount due and the forms of payment accepted.

The interview can last for as littles as 10 minutes or up to an hour depending upon your specific case. You relative will take an oath under US law to tell the truth, and it is very important that your relative answer every question as truthfully as possible. In general, it is a good idea that your relative bring documentation to prove strong ties and a relationship with you, the petitioner. (i.e. phone bills, letters etc.) If the consulate officer approves your relative's immigrant visa application, your relative will be issued an immigrant visa that allows your relative to become a US permanent resident. Your relative will become a U.S permanent resident only when he/she enters the U.S at a port of entry, until this time, he/she only has an immigrant visa that is valid up to 6 months from the interview date. If your relative cannot immigrate to the U.S within the 6 month allotted time, then his/her immigrant visa will expire, and the I-130 process must start all over again. At the bottom of either a CR-1 Spouse Visa or IR-1 Spouse Visa is the following sentence, "Upon Endorsement Serves As Temporary I-551 Valid For One Year." The endorsement is a standard CBP admission stamp with applicable information written in by the officer. This allows the visa itself to act as a temporary green card before the actual green card arrives in the mail. Additionally, if your relative is a CR-1 visa holder, the green card will only be valid for two years. Within ninety days before the green card expires, you will have to file an I-751 form to   remove it's conditional status .

Yesterday i got mail from Islamabad U.S. Embassy for oath and fingerprints  And updated the new medical Of my mother. Now I tell all story what happened  We have 4 applicants interview 21 November 2017 and 2 years we have to wait for the visa in AP. Recently, 2 months ago I got mail updated DS260 and two visa photos and updated medical I submitted all required document to the embassy and my status show expired after one month submitted documents and my mother and sister are expiring soon status show and 12 December updated our case, 3 applicants, in expiring soon to in AP and my still In expired and next day 13 December my case status in AP and I got mail 12 December for oath and fingerprints letter but in the letter, my name and case is not mentioned so I am worried about that why they have to miss my name for oath fingerprints our case is mother IR1 and we siblings 3 with mother Our case IR2  Previous interview together and fresh medical we have submitted of all applicants  Now I am worried about my case why they did not mention the name in the letter and another thing they asked mother new medex  which we have submitted of 1 month ago fresh medical of all applicants so now anyone helps me and guidance and suggest me

So my wife and I did the spousal visa . She’s in the states now but with that being said we’re still waiting for her physical green card and her social security to come through.   Do we have to follow through social security regarding about getting one or will the process it just like how we stated on the form of the application?

Hello everyone.

My name is Iryna. I am a Ukrainian citizen and going through the process of spouse visa CR1.

Filing all form I got really confused in some part. If someone went through this, I would really appreciate any of your advice!

Here are my questions about form I-130:

1. It is Part 4 Item number 53 - Was the Beneficiary EVER in immigration proceedings? - Does it apply only to the US immigration proceedings or it also applies to other countries as well? For example, I lived in Russia and went though the temporarily residence permit. Does it apply Russian? Thank you for your ideas.

2. What should I write in: "Date Marriage Ended" line if it is not ended and it is my current marriage with the US citizen?

Here are my questions about form I-130A:

1. I got confused with Part 3 page 3: "Information about your employment outside the USA" - I dont understand what exactly should be provided here if all of my jobs where outside the US? Because the Employment History was already provided in Part 2.

We received   RFE   form Uscis. I was wondering instead of sending it by mail which will take a couple of weeks can I upload the documents to my online account? Has any one done this before? The letters says you only get one chance to respond I don’t want to mess this up.

Hi you can upload online if they said it.  You just need to make sure the form is available online and you enter and provide the correct info. You can call the USCIS and ask them.directly at there 1800 num.

I have finished my medical examination already and i cannot make an interview appointment then i send email to us embassy they send me reply on my email and put there on my case status escalated to post. Then i wait for there email again until now no email how long i need to wait. Pls. Can anyone  give help i dont understand what's going on

Good day Everyone,   I got married in march of this year and waited till july to start my filing process because my husband joined the military in april. I have a little confusion on the address, as he has moved out of his apartment because of going to Military camp and all that. He wants me to stay at his family friend’s place as the address on the “where your spouse intends to stay”. I don’t know if this will affect us. Although he will get his apartment once i am settled in. Can someone help me out??

My Case is documentarily qualified (family visa) and in line for interview using my petitioner (Spouse) and my joint sponsor documents. Now, my joint sponsor is refused to give me his updated documents and I want to change him. My question is-

1. Is that possible to change my joint sponsor at this stage?

2. what are the prons and cons of the removal of this joint sponsor?

3. Does changing the joint sponsor affect my visa journey?

Bubu I'm not sure but I would think since u are in line for the interview just take all the correct documentation of the new joint sponsor to the interview and pray. Once your at the interview they are probably gonna ask for the joint sponsor info anyway. I hope this helps.

I'm curious why this guide says you have to mail in the I-130 forms and doesn't mention that they can be filed online. The USCIS website says you can file online and encourages it.  https://www.uscis.gov/i-130

What Is a Form I-130 Cover Letter?

You’ll need to file Form I-130 : Petition for Alien Relative if you are a U.S. citizen or green card holder who wants your family member to obtain lawful permanent resident status. You may petition on behalf of an immediate relative, such as a spouse, sibling , or parent. You may file this petition for your relatives even if they are outside of the United States. USCIS does not require a cover letter to process the I-130 petition. However, a cover letter can be beneficial. If there is anything unusual about you and your relative’s relationship, a cover letter also gives you the space to address these concerns. For example, if you are estranged from or have not seen your relative in a long time, you may want to use part of the cover letter to explain your situation to USCIS. You can explain why you have not been in contact for a long time and how getting a green card for your relative would help rebuild your relationship. By giving them greater clarity on circumstances like this, you can make it easier for USCIS to process your application.

What Should My Form I-130 Application Cover Letter Include?

You should begin your Form I-130 cover letter with a heading and greeting. Your heading should provide USCIS officials with your mailing address, your name, and your foreign relative’s name. Your introduction should then explain your reasons for writing this cover letter. Use your introduction to give USCIS a basic overview of your relationship and tell them you are sponsoring your relative’s green card application.

Checklist of Information To Include in Form I-130 Cover Letter

USCIS will find it most helpful if you include the following information in your cover letter:

Your contact information

The USCIS address to which you’re sending this letter

Your full name as the petitioner

Your relative’s full name as the beneficiary

A note stating which form and status you are filing an application for

A list of all the supporting documents you’ve included in this package, in bullet points:

Your birth certificate

Your relative’s passport, which must be valid for at least six months beyond their intended date of entry into the United States.

Two passport-style photographs that meet Department of State requirements . You and your relative must take two photos each within 30 days of filing.

You and your relative should each provide supporting documents relating to your address and employment histories for the last five years.

Your relative should also provide their I-94 information if they are present in the United States. If USCIS has involved your relative in any previous immigration proceedings, you’ll also need to disclose this.

If petitioning for your spouse, you’ll need to provide your marriage certificate. You must also prove that any of your prior marriages are legally terminated. For example, you may provide a divorce decree or a deceased spouse’s death certificate. Be sure to provide the date of termination if applicable.

When petitioning for a spouse, you’ll also need to prove that you have a bona fide marriage , meaning that your marriage is genuine. You may prove this by providing documents that show you have shared liabilities, assets, insurance, tax filings, children together, or other shared commitments.

Your signature and the date

Finally, you should conclude your letter by thanking USCIS for their consideration of your relative’s case. Be sure to sign and date the letter before enclosing it in the application package.

Filing Fee and Address Information for the Form I-130 Application

You may either file Form I-130 and your cover letter online or through a direct filing address in the mail. When filing, you’ll also need to include the $535 filing fee for this form. You may pay this fee with a money order, personal check, or cashier’s check. You should make any checks payable to the “U.S. Department of Homeland Security.” 

When filing at a USCIS lockbox, you also have the option to pay by credit card. To pay with a credit card, you’ll need to file Form G-1450 : Authorization for Credit Card Transactions.

Note that if you are using the direct consular filing process, you’ll need to work with your local U.S. embassy or consulate to determine fees. Your embassy may also require different documentation when considering your application.

Depending on what country you are applying from, you can submit the Schengen Visa application at:

  • An Embassy or Consulate of the Schengen country you are visiting.
  • The Embassy/Consulate of another Schengen country, in case the country you want to visit has no diplomatic representation in your place of residence.
