Coming to the UK after making a successful spouse visa application will allow you to enter initially for two and a half years, during which time you must reside with your spouse. If you wish, you can also undertake employment or study. After the initial two and a half years, you can apply for a further two and a half years, providing your circumstances remain the same. After completing five years in the UK as a spouse, you can apply for indefinite leave to remain on the basis of your relationship with your spouse.
To be eligible for a UK spouse visa, there are certain criteria that you and your spouse need to meet. Firstly, you must be married to your spouse and you must have met in person. Applying for a spouse visa is quite, if not very daunting for most of us for the mere reason that it’s full of technicalities. The amount of evidence to prove the application is tricky and sometimes just overwhelming but hey ho! We do what needs to be done.
There’s no exact checklist for a spouse visa application. It all depends on your circumstances to include the category of financial requirement as well as the type of accommodation you’re using and not to mention the relationship status you have. Of all these supporting documents you’re preparing for submission, a covering letter sometimes gets lost amidst the chaos. And almost always, it’s a disaster! Hah!
So, what is a covering letter? Why is it important for the spouse visa application? The answer is simple but packs a punch. The covering letter shows a snippet of the whole nine yards of your application. It explains in summary the what, why, where, when and how of your application. This is usually filed on top of the application supporting documents with the intent to give the Entry Clearance Officer or the Case Officer the overview of your case/application.

Relationship Requirement
At the time of making a Spouse Visa Extension, both the applicant and sponsor partner must:
If you are married or civil partners, you must be able to prove that you are in a legal marriage/civil partnership that is recognised in the UK. If not married (applying as an unmarried partner), you must provide evidence that your relationship is akin to a marriage and that you have lived with each other continuously for 2 years or more.
Financial Requirement
The Applicant and/or Sponsor must be able to show that they are earning or receiving income from their employment or other sources or else have significant savings, and that this income/savings is sufficient for themselves and their partner for the duration of their visa.
If you or your partner were first granted leave as a spouse/partner before 11 April 2024 (including if you first applied as a fiancé(e) or proposed civil partner), and you/they are extending that visa, the minimum income threshold is £18,600 gross per annum. This threshold increases to £22,400 where you are applying to extend with a dependant child, and then further increments of £2,400 for each additional child you are applying with (up to a maximum threshold of £29,000).
If you or your partner were first granted leave as a spouse/partner on or after 11 April 2024, the minimum income threshold is £29,000 gross per annum.
The English Language Requirement
Another requirement is evidence of sufficient knowledge of the English Language. Unless you reside in a country where English is the primary/dominant language e.g. USA or Australia, you will need to take an English Language Test which assesses your speaking and listening ability. This must be at a minimum level of A1 (if switching from another visa category) or A2 (if making a partner visa extension).
If you have a degree or academic qualification that was taught or researched in English and recognised by Ecctis (formerly UK NARIC), the English language requirement can also be satisfied.

Accommodation Requirement
You must also show that you have adequate accommodation for both of you (and any dependant children) to live in when you are in the UK. Adequate meaning that there will be no overcrowding as a result of you staying in the property.

What type of Documents do I need to prove I meet the requirements for a Spouse Visa Extension?
It is important to note as everyone's case is different with many possible variables in the applicant's/sponsor's personal circumstances. Therefore, there is no one size fits all list of specific documents applicants must submit . - Your own set documents must be tailored according to your and/or your partner's situation.
That being said, below are the type of items the UKVI will generally expect applicants to provide for their UK Spouse/Partner Visa application.
Documents to prove Relationship Requirement is met
For married/civil partners, the marriage/civil partnership certificate should be included in the application.
For spouse/partner visa extensions, you must also provide evidence of continuous cohabitation for the last period of leave granted (2.5 years) e.g. Joint Tenancy Agreement/s, letters of correspondence.
Documents to prove Financial Requirement is met
The documents you must provide need to prove the source of income being used to meet the minimum income requirement. For example if the applicant is relying on employment income, they will need to provide payslips, bank statements and employment contracts.
Documents to prove English Language Requirement is met
If the applicant is required to evidence a sufficient level of English Language, they must provide a copy of their English Language Test Certificate or their Degree certificate.
Documents to prove other requirements are met
For the accommodation requirement, the documents to be provided will depend on whether the property is owned, rented etc. So the relevant documents could be a copy of the tenancy agreement, letter from landlord, land registry title etc.
Translation of Documents
Any supporting documents that are not in English or Welsh must be translated. This will typically apply to items such as Marriage and Birth Certificates that originate from non-English speaking countries. I'm applying for the FLR(m) (half-way through the 5-year route). Do me and my spouse need to write a covering letter explaining why we want to be in the UK and why we're making the application like we did with the spouse visa? I remember when we went from Spouse visa to FLR(m) we didn't the first time round, but I'm wondering if the Entry Clearance Officer would expect one the second time around.
Hi, Sorry to be daft, but is it ILR you are applying for? as you mentioned that you already have gone through FLR(m) process once. I am also on spouse visa after which we applied for FLR(M) and now applying for ILR (Set M). We have written cover letter in at the time of spouse visa but not after that.
You're not being daft! My partner did Fiance Visa overseas, got married in the UK, then we did spouse visa (or was it FLR(m)? The form says FLR at the top), and now we're doing round 2 of FLR(m). I was reading this guide https://www.migrate.org.uk/flr-m-2018/#what-is-a-flr-m-application and Step 8 says to write them. I think I'll just do them anyway just to be sure.

You don't need a covering letter. Those are mostly useful for those who are applying for their initial visa as a couple, to give the ECO a more personal account of the relationship. It's not necessary for FLR(M), especially when you're proving you've been living together for the last 2.5 years, unless perhaps you have special circumstances which need to be explained (like moving out of the country or something).

How to make a referral to bring your family member to the UK if you were evacuated from Afghanistan under Pathway 1 of the Afghan citizens resettlement scheme.
If you have immediate family who were not evacuated at the same time as you, you may be eligible to bring them to the UK to settle permanently.
Pathway 1 of the Afghan citizens resettlement scheme (ACRS) is a resettlement scheme for vulnerable and at-risk people who arrived in the UK from Afghanistan under Operation PITTING in August 2021.
You can make a referral to ACRS Pathway 1 Stage 2: Separated Families from 30 July 2024 to 30 October 2024.
You and your family member should meet the requirements below.
You must have been evacuated to the UK from Afghanistan under ACRS Pathway 1 between the dates 13 August 2021 and 28 August 2021.
Your immediate family member should be one of the following:
Your immediate family member should be your parents, or your brother(s) or sister(s) that are under the age of 18.
Other family members may be considered where there are exceptional circumstances.
There are no fees to make a referral to the separated families pathway.
You will need to show that you were evacuated to the UK from Afghanistan under ACRS pathway 1. To do this you will need your biometric residence permit (BRP) or unique application number (UAN).
You’ll also need to provide sufficient documentation to prove that your family members meet the identity and relationship criteria of the pathway.
If you are planning to update your BRP to an eVisa, keep your BRP card as you will need it to make a referral. If you have already updated your BRP to an eVisa and no longer have your BRP card, contact [email protected]
You’ll need to prove your family member’s identity and your relationship with your family member. Evidence which may support your referral includes:
Other types of evidence may be accepted. For evidence that is not in English, you must upload a translation.
It is not mandatory to provide these documents, but it may help support your referral if you do. You should explain why you are unable to provide them, for example, if you lost them or had to leave them behind when you left Afghanistan.
You’ll need to wait for an eligibility decision. ACRS P1 Stage 2: Separated Families is a two-stage decision making process. If found to be eligible, the next stage will be for your family members to apply for entry clearance to the UK at the nearest visa application centre (VAC). You will be sent a letter with the eligibility decision and instructions on what to do next. Confirmation of eligibility does not constitute an immigration decision.
Your family member should not make any travel arrangements before you receive your letter. They will then need to pass security checks and provide their identity at a VAC before they can be issued with a visa to enter the UK.
If any of your eligible family members are children under the age of 18, they should make this journey with an adult. Children should not travel without an adult.
Before your eligible family members are offered a place on the ACRS, they will need to undergo security checks. This includes checks against security and other databases, as well as medical checks. Any offer on the ACRS is subject to these checks being successfully completed.
Your family member will need to have their photograph and fingerprints taken at a visa application centre (VAC) as part of the referral. There is no need to book an appointment. Once your eligible family members have left Afghanistan, they will be supported by the International Organisation for Migration (IOM) with accommodation and food whilst they submit their entry clearance application and undertake further checks.
There are no VACs in Afghanistan. Your family member can find their closest VAC .
Children under the age of 5 will not have their fingerprints taken but will still need to go to a VAC to have a digital photograph taken.
At the VAC, your family member will need to prove their identity with any identity documents they may have such as:
Your family member should still go to a VAC if they are unable to provide these documents. They should explain why they are unable to provide them - for example, if they had to leave their documents behind when they left.
ACRS P1 Stage 2: Separated Families is a two-stage decision making process. Any offer of resettlement made by the Home Office, including as an immediate or additional family member, is dependent on the individual passing the necessary immigration suitability and security checks. Confirmation of eligibility does not constitute an immigration decision.

You must make your referral by filling in the online form. You can make a referral from 30 July 2024 to 30 October 2024.
You will need your BRP number or UAN and your date of birth to complete the referral form.
Use the same sign in number each time. An error message will appear and you will not be able to sign in if you switch between BRP and UAN numbers. If you do not do anything for 30 minutes, you will be signed out and lose any unsaved answers. This is to keep your information safe.
You can fill in the form yourself, or someone else can fill out the form on your behalf such as a friend, support worker or registered immigration adviser.

You will be given the option to fill out the form as a registered immigration advisor or someone helping the referrer.
Immigration advisors must be authorised to act on the person’s behalf.

Add the referrer’s contact details so that they have access to the application form and all the decision letters.
