Exhibit A: Top trial presentation tools

I’ve watched clips of Johnny Depp's defamation trial with interest. The proceeding offers a fascinating view into the lives of the rich and famous and also is a prime example of how court will likely be conducted post-pandemic. This trial is notable not only because it is televised, but also because it includes testimony from many in-person witnesses and several others via videoconference. Of those participating remotely, some testified live and the testimony of others was pre-recorded.

As the Depp trial exemplifies, in-person court proceedings aren’t going away. Trials will occur in brick-and-mortar courtrooms moving forward, and technology will facilitate in-person proceedings just as it does virtual ones.

This “hybrid” trial is likely a sign of things to come as we head into the next phase of the pandemic, one where COVID-19 surges come and go. This continued unpredictability means that courts will need to embrace flexibility to remain operable no matter the circumstances. That’s why in my last two columns, I focused on deposition and court reporting software that enables the remote recording of testimony; these tools will be essential to the ability to administer justice in the weeks and months ahead.

After my most recent column covering court reporting tools was published, an email arrived from a reader of this column who wondered if I had any recommendations about tools to facilitate the in-person trial presentation of exhibits.

While this isn’t a topic I’ve yet covered in this column, there are many tools now available in this category of software. Most of the tools discussed below are cloud-based, although I’ll also briefly cover the tried-and-true—and often clunky-and-complex—premises-based trial presentation platforms as well.

But before I dive into the offerings, it’s important to note, as I always do, that the majority of software programs discussed below are cloud-based, which means data will be housed on servers owned by a third party. Because you’ll be entrusting your law firm’s data to a third party, you have an ethical duty to vet the technology provider hosting and storing your data thoroughly. This includes ensuring you understand how that company will handle the data; where the servers that will store the data are located; who will have access to the data; and how and when it will be backed up, among other things.

Now I’ll review some of the options available, with a focus on the more modern, cloud-based tools discussed first.

Let’s start with four companion products from Lit Software that facilitate trial preparation and presentation: TrialPad , TranscriptPad , DocReviewPad and ExhibitsPad . These tools are designed for use on iPads only. Each app has its own trial function and offers unique ways to present your case to the finder of fact. A 7-day free trial is available for each app, and the pricing for the suite of all four apps is $399 per year. The apps cannot be purchased separately.

With DocReviewPad, you can annotate, review and produce documents. The companion app, ExhibitsPad, enables sharing trial exhibits with the fact finder so long as you provide jurors and/or the judge with an iPad for viewing and interacting with the exhibits.

TranscriptPad allows you to import deposition transcripts from a number of different sources, including many typical cloud providers and AirDrop. Once imported, you can read, annotate and search transcripts.

TrialPad is designed for trial presentation. You can organize, annotate and present trial evidence via an intuitive and easy-to-use interface using this app. Once files are imported from major cloud providers, AirDrop and more can be displayed using VGA or HDMI-compatible projectors. As is the case with most trial presentation software programs, you can call out certain sections of documents, zoom in and out and much more.

Next is ExhibitView Solutions . This company offers a number of trial preparation tools as well as both premises-based and cloud options. ExhibitView Trial Presenter is a premises-based trial presentation software tool that is compatible with PCs only. There is a 14-day trial available for ExhibitView, and the cost is $549 for two installations.

For lawyers seeking the ease and intuitiveness of an iPad interface, the company also offers a trial presentation iPad app, iTrial , which costs $99.99 and can be used as a standalone trial presentation tool. It also integrates with ExhibitView via Dropbox, which means you can prepare for trial using ExhibitView and then present at trial using iTrial.

TranscriptPro is another PC-compatible software tool that supports video deposition editing and facilitates digital transcript review. A 14-day trial is offered, and the cost is $249 for two installations.

Exhibit Presenter is another PC-based trial presentation tool. With this software, you can share and manipulate PDF exhibits in court as you present your case. This tool is an affordable one and costs $99 to download . There is a free demo version available as well.

Once it’s released, another option to consider for trial presentation is iLitigate , an iPad app. Right now, this software is available only to beta testers and pricing is not available. This software will provide tools to facilitate a legal team’s pre-trial case preparation and collaboration and includes document review functionality and trial presentation capabilities.

Finally, because I include premises-based software in this article, I would be remiss if I failed to mention TrialDirector and OnCue , two of the most well-known and robust trial presentation software suites. Both have been around for years and are popular choices, especially among larger law firm users, in part because those firms have the staff and resources needed for the implementation and training required to use these tools. The cost for TrialDirector is not available on the company’s website, and pricing for OnCue ranges from $80 per month to $780 per year for two activations per license.

The bottom line: If you’re in the market for trial presentation software, there is likely a tool that fits your needs. Your task will be to choose a program compatible with your firm’s operating systems and budget. Narrow your options accordingly, and take advantage of any free trials offered. Give the software a test run and determine if the interface is intuitive and robust enough for your needs. From there, you should be well on your way to effectively presenting your client’s case with ease.

Great product, great price..

This is a great and much needed replacement for Trial Pad. This does everything Trial Pad does and more, and without $500 per year subscription that Trial Pad charges you. I used to recommend to other practitioners Trial Pad, but that was before they got overly greedy and forced you to a subscription service with other garbage app bundle you don’t need. I was desperately looking for a replacement for Trial Pad when I found this. This does everything I need for exhibit presentation and much more intuitively than I expected. I will be recommending this app from now on. If you are a solo litigator, small firm practitioner or who simply doesn’t need complex database program to manage your exhibits and present them to the jury, this is a must.

Wasted $100

From what I could see, this app has no callout feature. That is a critical function that at minimum should be included in an application trying to compete with TrialPad. Second, the reviewer that says trial pad is a $500 subscription, is flat out lying. True it is $400, but it is not $500. Next, I was completely unable to import from Dropbox. Support reached out to me, asked me to be patient, and to try importing from some other unidentified method. If I cannot import from dropbox, and have to figure out some other way to get exhibits into this application, I consider this a complete and utter waste of money. I cannot recommend it.

Very good trial presentation app

I’m a criminal trial attorney and have used Exhibit View for the last three generations. They have served me well. I can walk around the courtroom, connected wirelessly, and project what I want on the screen for the jury. It’s pretty easy to use.

How do I use TrialPad to present evidence?

TrialPad allows you to present evidence using a wireless connection (using an Apple TV ) or a wired connection (using an HDMI cable). It is also possible to use a VGA cable but this is not recommended as VGA is older technology and the cable does not carry the audio.

Present Evidence - Wireless

With a wireless connection, the iPad or Mac wirelessly transmits the presentation to an Apple TV , which is connected to a TV or projector using an HDMI cable . The iPad, Mac, and Apple TV need to have WiFi and Bluetooth enabled to communicate with each other using Peer-to-Peer AirPlay (they do not need to be connected to a WiFi network or the internet). For the best performance use the Apple TV 4K or later model, and have it less than 100 feet away from the iPad or Mac.

Present Evidence - Wired

With a wired connection, the iPad or Mac is connected to a TV or projector using an HDMI cable . For an iPad or Mac with a USB-C output you will need the USB-C Digital AV Multiport Adapter to connect the HDMI cable. Note : An HDMI cable should not be longer than 50 feet as it can result in signal degradation. It is also possible to use a VGA cable but this is not recommended as VGA is older technology and the cable does not carry the audio. See the matrix at the end of this support article for the various adapters required for different setups. Make sure to only use genuine Apple adapters bought directly from Apple as some third-party adapters will not work.

The old saying “a picture is worth 1000 words” certainly applies at trial. For that reason, demonstrative evidence presented and effective use of trial exhibits and video are critical to the success of the trial attorney.

Trial Pad is Easy to Learn

There are many options available for the practitioner to present evidence in a powerful way to their jury. Unfortunately, there is a learning curve for each program for trial presentations.

This is a review of Lit Software’s TrialPad for iPad. If you own an iPad, and most likely you do, consider TrialPad as an option for your next trial. The learning curve is slight, and the software is well-developed and easy to use. The company has updated this app repeatedly, making it more useful and user-friendly.

Download Documents in a Snap

Getting documents or images into your iPad is extremely easy, particularly if you are already a Dropbox or Box.com user. With the touch of a button, you can add to and move documents around TrialPad effortlessly.

Probably the most beautiful part of the program is its simplicity. One of the easiest and most effective methods of focusing on specific parts of an exhibit in the program is the “call out” feature that allows you to instantly blow up a specific document for viewing by the jury using only your fingers.

An attorney trying a truck accident case can pull up a crash report and highlight parts quickly and effectively.

Call Outs and Highlights

Highlighting is also a straightforward method to call attention to a specific part of an exhibit. Many other features are incredibly easy to learn and use, such as redacting or annotating.

Another extremely attractive function is a button that allows you to “cue up” your next image without the jury seeing what you are looking at on your iPad.

Hot Documents

One feature of TrialPad that I love is the “hot document” component that lets you save your key documents with a button in a special location and prepare the documents through highlighting or annotation before your presentation.

Well Organized

File folders organize cases, and the design is an extremely user-friendly backup should you so desire is simple to use.

Certainly, once you spend an hour with this program, you will no longer be interested in paying for “foam board” exhibits for use at trial.

Most people do not make the technology leap because of fear of the unknown; with this program, learning how to use the app is just a small hop.

Helps Trial Preparation

Not only is the program easy to use, but I have also found that the program actually aids in trial preparation and organization. Once you have used TrialPad, you soon forget about calling a hired service to do your technology presentation.

Another benefit of using an iPad at trial and this wonderfully easy-to-use software is that your case is literally on your iPad, and carting your paper files to court no longer seems necessary. Technology for personal injury lawyers has been a delightful part of our firm.

TrialPad has been updated continuously and continues to evolve and improve with each version. You will be hooked if you dedicate 30 minutes to viewing the online videos of how to get started with the program first and dedicate another hour to hands-on fooling around with the program.

I Highly Recommend Trial Pad for Trial Lawyers

I highly recommend TrialPad for many reasons and think that the money you spend on the program will be the best money you have spent in quite a while. Trial Pad is now sold in a bundle with a document review app and a deposition transcript app. All are intuitive and easy to use.

TrialPad has made preparing for trial in my Houston personal injury practice much more organized and fun!

For those who feel technologically challenged, this is the program for you to get your feet wet.

Michael Ko – Groundworks Trial Consulting

Mike Ko, owner of Groundworks Trial Consulting , has been operating technology at trials since 2008. As a professor at the Chicago-Kent College of Law, he frequently demonstrates the power of presentation technology to his students.

Recently, I asked Ko for his short list of technology aids that any attorney can use to improve trial presentations. In no particular order, these are some of Ko’s must-haves that won’t break the bank.

1. Dropbox account

Using trial presentation software becomes even more efficient with easy access to case files via cloud storage like Dropbox.

“Cloud storage is one convenient resource for getting files to local storage on your mobile device, so they can be loaded into whatever app you’re presenting on. A free Dropbox account typically has enough storage for a handful of active cases at a time.”

2. Trial presentation apps

Trial presentation software embedded in eDiscovery apps streamlines your workflow, ensuring you’re always ready for court.

“A few eDiscovery softwares come with their own trial presentation apps, or have a presentation mode built in. (Editor’s Note: Nextpoint Prep, the software  Ko teaches on at Chicago-Kent, runs on all major browsers). This is functionality that users sometimes don’t even know they have.

“If your eDiscovery software doesn’t do trial presentation, but you do have an iPad, check out TrialPad. Prices have gone up quite a bit over the years, but it’s still a value. The limitation is that there’s no Android or browser-based version.”

3. A mouse that works on glass

A reliable mouse enhances your control over trial presentation tools, regardless of courtroom setup.

“Many federal and state courthouses have glass counsel tables. Most popular mouses don’t work on glass, because the reflective surface doesn’t jibe well with their optical tracking technology. An ‘air mouse’ that isn’t limited by the surface it rests on—like Logitech’s Anywhere MX —is a more versatile tool that can prove to be a great investment.”

4. A remote presenter

Utilizing a remote presenter during trial presentation allows for seamless and dynamic courtroom presentations.

“If your presentation includes slides, it may be more effective to control it remotely rather than being tethered to a computer. I prefer remotes with USB receivers for more universal reliability. For illustrative purposes, it’s also nice to have an integrated laser pointer.”

5. USB thumb drive

Keeping trial presentation files on USB thumb drives ensures quick and easy access, even in the absence of internet connectivity.

“I generally just keep a handful of these around that hold 4-8GB, and can be treated as disposable. They’re very handy when working in teams with large files—especially when the only internet you have is a MiFi (mobile hotspot).”

6. Adobe Acrobat DC

Integrating Adobe Acrobat DC simplifies document management, enhancing your trial preparation.

“The full version of Acrobat is useful for all aspects of litigation, including Bates stamping, electronic signatures, rearranging/combining pages in a document, or applying exhibit stickers. There is a free version available, but some of the aforementioned tasks can’t be done with the free version.”

7. Laser pointers

Laser pointers, whether integrated into your remote presenter or separate, can enhance your ability to highlight key points.

“I usually use the one in the remote presenter, but I also bring a handful of these to trial. Sometimes, you may also want to give one to the witness. And they get lost.”

8. A wireless hotspot

A wireless hotspot ensures that you’re always connected, facilitating uninterrupted access to critical case information.

“I don’t usually need one, as I can typically tether from my phone. But they’re useful if your team frequently spends a lot of time in courtrooms that don’t have internet access.”
